Privacy Policy

This Privacy Policy sets out the rules for processing and protecting the personal data of users of the softwero.pl website, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
1. Data Controller
The controller of personal data collected through the website is Piotr Szymocha (Polish Tax Identification Number (NIP): 8121324881), who operates the website under the softwero brand. You can contact the Controller by email at contact@softwero.pl. The Controller has not appointed a Data Protection Officer. For all matters concerning the processing of personal data, you may contact the Controller directly at the address above.
2. Purposes and Legal Bases for Processing
Personal data is processed for the following purposes:
- responding to an enquiry submitted through the contact form and taking steps at the data subject's request before potentially entering into a contract (Article 6(1)(b) and (f) GDPR, namely the Controller's legitimate interest in handling correspondence and enquiries),
- performing contracts and providing services (Article 6(1)(b) GDPR),
- compiling anonymous website traffic statistics using Google Analytics (Article 6(1)(a) GDPR, namely consent given through the cookie banner),
- establishing, pursuing or defending possible legal claims (Article 6(1)(f) GDPR).
3. Data Recipients and Transfers Outside the EEA
Personal data may be entrusted to entities that process it on the Controller's behalf, to the extent necessary for the operation of the website:
- the hosting and email provider (Hostinger International Ltd.), whose servers host the website and handle correspondence from the contact form,
- Google Ireland Ltd., in connection with the Google Analytics service.
The use of Google Analytics may involve transferring data to a third country (the United States). Google states that it uses mechanisms designed to ensure an adequate level of data protection, including the Data Privacy Framework and standard contractual clauses.
4. Data Retention Period
- contact form data: for the time necessary to handle the enquiry and related correspondence, and then until the limitation period for any claims expires or until an effective objection is made,
- data connected with a concluded contract: for the period required by law, in particular tax and accounting laws,
- data processed on the basis of consent (statistics): until consent is withdrawn or the cookies expire.
5. Cookies
The softwero.pl website uses essential cookies that are necessary for the website to function properly and, after obtaining the user's consent, Google Analytics cookies used to collect anonymous statistics. Analytics cookies are enabled only after the user gives consent through the cookie banner.
Users may withdraw their consent at any time by deleting their saved preferences and cookies in their web browser settings. Withdrawing consent does not affect the lawfulness of processing carried out before the consent was withdrawn.
6. Voluntary Provision of Data
Providing personal data is voluntary. However, a name, email address and message are required to submit an enquiry through the contact form and receive a response. Without this data, the enquiry cannot be handled.
7. Your Rights
Every data subject has the right to:
- Access their personal data and receive a copy of it,
- Rectify (correct) their personal data,
- Erase their personal data (the right to be forgotten),
- Restrict the processing of their personal data,
- Data portability,
- Object to the processing of their personal data,
- Withdraw consent at any time, without affecting the lawfulness of processing carried out before consent was withdrawn,
- Lodge a complaint with the supervisory authority, namely the President of the Personal Data Protection Office (2 Stawki Street, 00-193 Warsaw), if they consider that the processing infringes the GDPR.
8. Automated Decision-Making and Profiling
Personal data is not used for automated decision-making that produces legal effects concerning the user, including profiling in that sense. Analytics tools process data solely in the form of aggregate, anonymous statistics.
